Terms of Business

How we deal with you, and the rules for using this site.

Who we are

These terms are published by Axtraction AI Sdn Bhd (no. 202301042335), a company registered in Malaysia with its office at Level 27 Penthouse, Centrepoint North, Mid Valley City, Lingkaran Syed Putra, 59200 Kuala Lumpur. Our group also includes Axtraction AI Limited (no. 79826532), registered in Hong Kong SAR at Unit 2A, 17/F, Glenealy Tower, 1 Glenealy, Central.

"Axtraction AI", "we" and "us" mean whichever of those two companies you are dealing with. Unless we tell you otherwise in writing, that company is Axtraction AI Sdn Bhd, and it is the company that publishes and operates this website.

What these terms are for

They cover two things: your use of axtraction.ai, and the basis on which we deal with you generally before anything is signed. Using the site means you accept them. If you do not accept them, please do not use the site.

They are not our terms of supply. We do not sell anything through this website, and nothing here sets out what we would deliver, when, or on what commercial terms. That is settled in a written agreement, described below.

What this website is

The site describes what we build, who it is for, and how we deliver it. It is published for general information.

Nothing on this site is an offer capable of acceptance. No page quotes a price, and nothing you can do here forms a contract with us. Where a page invites you to get in touch, that is an invitation to start a conversation, not an offer. A message you send us is not an order, and we are not bound until an authorised signatory of ours signs an agreement or accepts an order in writing.

We may change, move or withdraw anything on the site at any time, and we are under no obligation to keep it available. Pages describe our products as they stood when the page was written. A product can change after that.

Nothing here is advice, and product descriptions are illustrative

Nothing on this site is legal, regulatory, security, tax, financial or other professional advice, and you should not act on it as though it were. Take your own advice on your own situation.

Product descriptions are illustrative. They explain the kind of work a product does, not what it will do for your organisation. The screens, figures and labels inside the product illustrations are drawn to show a layout. They are examples, not results, benchmarks or measured performance.

What a deployment actually connects, validates, posts or helps a person review depends on your data, your systems, your constraints and the scope we agree. We work that out with you first, and it is recorded in writing.

The site and its content belong to us

The text, layout, code, illustrations, images and typography on this site are owned by Axtraction AI or licensed to it, as are the Axtraction AI name, the wordmark and the AX mark. Copyright and trade mark law in Malaysia and elsewhere protects them. Nothing on this page gives you any right in them beyond what it says.

You may read the pages, print or save a copy for your own reference, and quote a short extract if you credit us and link to the page you took it from.

You need our written permission for anything else. That includes republishing a page or a substantial part of one, copying the site systematically or by automated means, using its content to build or train a product or model, and presenting our content as your own.

Logo files are published at Brand assets for press and partner use, on the usage note given there. Do not recolour, stretch or rebuild the marks, and do not use them in a way that suggests we endorse you or are connected with you. Other companies' names and marks that appear on this site belong to their owners, and we name them only to say what our products connect to or how a purchase can be transacted.

Using this site

There is nothing to sign up for here. The site has no accounts, no forms and no payment, and it asks you to submit nothing. Use it for lawful purposes and leave it working for everyone else.

Please do not:

  • try to gain access you were not given to the site, its hosting, or any system connected to it;
  • interfere with the site or its availability, including by overloading it or by introducing anything harmful;
  • harvest the site in bulk by automated means, or reproduce it so that it appears to be yours;
  • use our published email addresses to send bulk unsolicited mail, or to pass our addresses to anyone else for that purpose;
  • hold yourself out as acting for Axtraction AI, or as reselling or representing our products, unless we have agreed that in writing.

Where we reasonably believe someone is doing any of that, we may block access. If you find a security weakness in this site or in one of our products, please report it to security@axtraction.ai rather than testing further.

When we work together, a separate agreement governs

We contract with customers and partners under separate written agreements. Where such an agreement is in place between you and us, that agreement governs. These terms do not add to it, cut across it, or reduce anything in it, and if anything on this page conflicts with it, your agreement wins.

Our standard Data Processing Addendum, which governs personal data we process inside a customer's deployment, is published in full so you can read it before you are asked to sign anything. Our End-User Licence Terms, on which each end user is licensed, and our Partner Data Processing Addendum, which applies to distributors and resellers, are published in full alongside it. Write to us if you would like a signed and dated copy of any version.

Publishing a document does not put you under it. Each applies only through the agreement that incorporates it. This page sets no service level and describes no support commitment: what support covers, and the hours it runs, are set in the agreement that applies to your deployment. Personal data

How we handle personal data is set out in the Privacy Policy. It covers visitors to this site, people who email us, and our role when personal data sits inside a customer's deployment.

Two facts about this site are stated there and worth repeating. It sets no cookies, and it runs no analytics, no tracking pixels and no third-party scripts. Even the typeface is served from our own domain, so opening a page sends no request to any domain other than ours.

Email is not a secure channel. Please do not send us sensitive material by email. Tell us what you need to share and we can arrange a safer route.

The site is provided as it is

We take care over what we publish, but we do not warrant that the site is accurate, complete, current, uninterrupted or free of error, or that it or its server is free of anything harmful. To the fullest extent the law allows, we exclude all warranties, conditions and terms that would otherwise be implied.

Where we link to another organisation's site, the link is for convenience. We do not control that site and we are not responsible for its content or its handling of your data.

Our liability for this website

This section is about the website only. Liability under an agreement between us is dealt with in that agreement, and nothing here changes it.

To the fullest extent the law allows, we are not liable for loss or damage arising from your use of this site, from your inability to use it, or from reliance on anything published on it. That includes lost profit, lost business, lost data, loss of anticipated savings, and any indirect or consequential loss.

Where liability cannot be excluded, it is limited to direct loss that you can show this site caused, and it goes no further. The site is published for information, is free to read and carries no transaction, so the limit matches what it is.

Nothing in these terms limits liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be limited.

Governing law

These terms, and any dispute or claim arising out of them or out of this website, including a non-contractual one, are governed by the laws of Malaysia. The courts of Malaysia have exclusive jurisdiction over any such dispute or claim.

Where a separate written agreement between us names a different governing law or forum, that agreement applies to matters arising under it.

Changes to these terms

We may update these terms. The version on this page is the current one, and the effective date at the top changes when we update it. Using the site after that date means the updated terms apply to that use.

A change here does not change an agreement already in place between us. Those change only in the way that agreement provides.

The rest

If any part of these terms turns out to be unenforceable, the rest stays in force. If we do not enforce something straight away, we do not give up the right to enforce it later. These terms do not create a partnership, an agency or a joint venture between us, and no one is authorised to speak or contract for Axtraction AI without our written authority.
